General terms and conditions for BulkSMS services

1. Acceptance of Terms

By creating an account or using BulkSMS services, you agree to these Terms of Use and our Privacy Policy. Continued use after changes means acceptance of the new conditions.

2. Description of Services

BulkSMS provides a CPaaS (Communications Platform as a Service) platform including A2P SMS, WhatsApp Business API, Voice (TTS, SIP), Chatbot, Verify APIs, and Network APIs. Services are provided according to the contracted plan and the limits described on the dashboard.

3. Permitted Use

The client may use the services for:

  • Legitimate communications with customers who consented to receive messages
  • User authentication and verification
  • Transactional notifications related to services contracted by the recipient
  • Marketing with documented opt-in and an opt-out mechanism

4. Prohibited Uses

  • Spam, unsolicited messages, or sending to purchased lists
  • Illegal, fraudulent, defamatory, or misleading content
  • Phishing, scams, or impersonation of other companies
  • Violation of LGPD or other applicable regulations
  • Use of recipient numbers obtained illegally
  • Abuse of rate limits or attempts to bypass security mechanisms

5. Billing and Payment

Services are billed monthly in Brazilian Reais (BRL). The client is responsible for paying all consumed volumes, including overages beyond plan limits. Delays may result in suspension of the service after 5 business days prior notice.

6. SLA and Availability

BulkSMS guarantees service levels (SLA) described in each plan. Incidents causing downtime exceeding the contracted SLA will generate proportional credit on the next invoice, according to calculations on the status page.

7. Termination

The client may cancel their account at any time with 30 days notice. BulkSMS may suspend or terminate accounts that violate these terms, with no refund for consumed volumes.

8. Limitation of Liability

BulkSMS’s liability for direct damages is limited to the amount paid by the client in the 3 months prior to the incident. BulkSMS is not liable for indirect, punitive, or consequential damages.

9. Governing Law and Jurisdiction

These terms are governed by Brazilian laws. The courts of the Judicial District of São Paulo, SP, are elected for the resolution of any disputes, waiving any other jurisdiction.
